Welcome to Amplifire Media Works LLP ("Amplifire", "we", "us"), a content, visibility and communications agency that helps founders, professionals, firms and companies become known for what they do best. Any interaction with Amplifire, and/or with The Daily Lawyer ("TDL"), our owned media platform and podcast - whether as a visitor on this website; as a client or prospective client; as a podcast guest, speaker or contributor; as a sponsor, vendor, collaborator or partner; across our social media handles; or in any in-person or virtual meeting or event (together, the "Platform") - is governed by these Terms & Conditions ("T&C").

By interacting with the Platform in any form, the user confirms that these T&C have been read, understood and accepted. Amplifire reserves the right to modify, supplement, suspend, discontinue or otherwise revise these T&C, and the content, Services and prices available across the Platform, at any time and without prior notice, and further reserves the right to refuse, decline, pause or discontinue any mandate to any person or entity, at its sole discretion and at any time.

The Platform is provided for the purpose of disseminating information regarding Amplifire, TDL, and their respective services, shows and events, and shall be used only for lawful purposes.

The user shall not violate any applicable law or intellectual property right, transmit any virus or other destructive code, attempt unauthorised access to the Platform, or scrape or bulk-download Content by automated or other means.

Any breach of the foregoing will result in the immediate termination of any Services availed by the user, and/or such further legal and protective action as may be advised.

Specific Terms regarding working with Amplifire or TDL:

Work on any mandate begins only on receipt of specified fees. All fees are exclusive of GST/ other applicable taxes, and third-party costs. A delay fee may apply where feedback or approvals are held up beyond the agreed timeline, and a rush fee may apply where an expedited turnaround is required, the amount in each case being communicated in advance; on overdue invoices, Amplifire may charge interest and suspend all work, publishing and access until payment is received, without liability for any consequence of that suspension. All fees, once paid, are strictly non-refundable and non-transferable.

Communications is a craft, not a guarantee. Amplifire commits to professional effort, judgement and execution, but does not guarantee any business outcome or any level of reach, impressions, engagement, followers, subscribers, downloads or views; any search ranking, feed placement or algorithmic outcome; any media coverage, publication, byline, award, listing or speaking slot, editorial and jury decisions being outside Amplifire's control.

Amplifire may use a client's name, logo, and the images, video, audio and creative produced during an engagement, to showcase its work, at its discretion; a client who does not wish to be identified publicly should notify Amplifire in writing, and the reference will be anonymised within a reasonable period.

Each party shall keep confidential the other party's non-public business information, strategy, data and communications, shall use the same solely for the purposes of the engagement, and shall disclose the same only to such of its personnel and sub-contractors as are bound by equivalent obligations of confidentiality, this obligation surviving the termination or completion of the engagement.

Amplifire collects and processes personal data solely to the extent necessary to respond to enquiries, deliver and administer the Services, produce and publish content, raise invoices and comply with statutory obligations, and issue communications to which the data subject has consented.

Such data shall not be sold, and shall be disclosed only to service providers processing it under contractual safeguards, to Amplifire's professional advisers, where consented to, or where required by applicable law.

Personal data shall be retained only for so long as the purpose for which it was collected subsists or as mandated by law, and shall be protected by reasonable security safeguards throughout.

The Platform may contain links to third-party websites and platforms, for the content, accuracy, availability and privacy practices of which Amplifire accepts no responsibility, and the presence of which shall not be construed as an endorsement of or affiliation with the linked site.

While Amplifire makes reasonable efforts to ensure the accuracy of information published on the Platform, no warranty is given as to its completeness, accuracy or timeliness, and the Platform is provided on an "as is" and "as available" basis, use of which is at the user's own risk.

Amplifire's aggregate liability arising out of the Platform, the Services or these T&C, whether in contract, tort or otherwise, shall in no event exceed the fees actually paid by the user for the mandate giving rise to the claim in the three (3) months preceding the event giving rise thereto.

Amplifire shall in no circumstance be liable for indirect, incidental, consequential or special damages, or for loss of profit, revenue, business, goodwill, reputation, opportunity or data, save where such exclusion is not permitted by law, in which case liability shall be limited to the fullest extent the law permits.

The user shall indemnify and keep indemnified Amplifire, its partners, affiliates, employees and agents against any claim, loss, liability, penalty, cost or expense arising from the user's use of the Platform, breach of these T&C, the inaccuracy of information or claims supplied or approved by the user, or the user's breach of any law or professional conduct rule applicable to the user.

Any dissatisfaction shall in the first instance be communicated to Amplifire promptly and constructively, to permit an opportunity for resolution.

The user undertakes not to engage in any oral, written or online communication, including public statements, social media posts or reviews, that is disparaging or defamatory of Amplifire, TDL, their personnel or their work, save for truthful statements required by law or made to a regulator or court; this undertaking survives termination.

A retainer may be terminated by either party on thirty (30) days' written notice, fees for the notice period remaining payable, or immediately upon an uncured material breach.

Upon termination, all accrued fees shall become immediately payable, fees already paid shall not be refunded, and Amplifire shall, subject to receipt of full payment, deliver approved final deliverables and relinquish access to the user's accounts; Amplifire shall be under no obligation to retain project files or raw footage beyond ninety (90) days following termination.

Neither party shall be liable for any delay or failure of performance occasioned by events beyond its reasonable control, including natural disaster, epidemic, fire, flood, war, civil unrest, act of government, strike, cyber-attack, or failure of power, telecommunications or any third-party platform, provided that accrued payment obligations shall not thereby be excused.

These T&C shall be governed by the laws of India, and the courts at Mumbai shall have exclusive jurisdiction over any dispute arising hereunder or out of the use of the Platform; the parties agree to first attempt in good faith to resolve any dispute through discussion within thirty (30) days of written notice thereof.

These T&C supersede all prior agreements, communications and proposals, whether written or oral, including any earlier version hereof; any ambiguity in interpretation shall not be construed against Amplifire; any provision held invalid shall be severed without affecting the remainder; and no failure to enforce any provision shall constitute a waiver thereof.

Nothing herein shall be construed to create a partnership, joint venture or agency relationship between the parties.
